Legal and ethical issues around incorporating traditional knowledge in polar data infrastructures.

Human knowledge of the polar region is a unique blend of Western scientific knowledge and local and indigenous knowledge. It is increasingly recognized that to exclude Traditional Knowledge from repositories of polar data would both limit the value of such repositories and perpetuate colonial legacies of exclusion and exploitation. However, the inclusion of Traditional Knowledge within repositories that are conceived and designed for Western scientific knowledge raises its own unique challenges. There is increasing acceptance of the need to make these two knowledge systems interoperable but in addition to the technical challenge there are legal and ethical issues involved. These relate to ‘ownership’ or custodianship of the knowledge; obtaining appropriate consent to gather, use and incorporate this knowledge; being sensitive to potentially different norms regarding access to and sharing of some types of knowledge; and appropriate acknowledgement for data contributors. In some cases, respectful incorporation of Traditional Knowledge may challenge standard conceptions regarding the sharing of data, including through open data licensing. These issues have not been fully addressed in the existing literature on legal interoperability which does not adequately deal with Traditional Knowledge. In this paper we identify legal and ethical norms regarding the use of Traditional Knowledge and explore their application in the particular context of polar data. Drawing upon our earlier work on cybercartography and Traditional Knowledge we identify the elements required in the development of a framework for the inclusion of Traditional Knowledge within data infrastructures.

An appeal for a code of conduct for marine conservation.

Marine conservation actions are promoted to conserve natural values and support human wellbeing. Yet the quality of governance processes and the social consequences of some marine conservation initiatives have been the subject of critique and even human rights complaints. These types of governance and social issues may jeopardize the legitimacy of, support for and long-term effectiveness of marine conservation. Thus, we argue that a clearly articulated and comprehensive set of social standards – a code of conduct – is needed to guide marine conservation. In this paper, we draw on the results of an expert meeting and scoping review to present key principles that might be taken into account in a code of conduct, to propose a draft set of foundational elements for inclusion in a code of conduct, to discuss the benefits and challenges of such a document, and to propose next steps to develop and facilitate the uptake of a broadly applicable code of conduct within the marine conservation community. The objectives of developing such a code of conduct are to promote fair conservation governance and decision-making, socially just conservation actions and outcomes, and accountable conservation practitioners and organizations. The uptake and implementation of a code of conduct would enable marine conservation to be both socially acceptable and ecologically effective, thereby contributing to a truly sustainable ocean.

On governance in fisheries in Senegal: from top-down control to co-management.

The trans-disciplinary thematic areas of oceans management and policy require stocktaking of the state of knowledge on ecosystem services being derived from coastal and marine areas. Recently adopted Sustainable Development Goals (SDGs) especially Goals 14 and 15 explicitly focus on this. This Handbook brings together a carefully chosen set of world-class contributions from ecology, economics, and other development science and attempts to provide policy relevant scientific information on ecosystem services from marine and coastal ecosystems, nuances of economic valuation, relevant legal and sociological response policies for effective management of marine areas for enhanced human well being. The contributors focus on the possible nexus of science-society and science-policy with the objective of informing on decision makers of the governmental agencies, business and industry and civil society in general with respect to sustainable management of Oceans. Chapter in Handbook on the Economics and Management of Sustainable Oceans

Trade and sustainable fisheries.

The ultimate goal of this contribution is to formulate fish trade policy recommendations that can be deployed to help achieve the relevant Sustainable Development Goals of the United Nations (SDGs). Even though all the 17 SDGs are relevant to the issues addressed in this contribution, I will focus on SDG14: Life under the water, and also SDG 1: (No poverty); 2: (Zero hunger); 3: (Gender equality); 4: (Reduced inequality); and 12: (Responsible consumption and production). Before I get to the recommendations, I will review the literature on the relationship between fish trade and sustainable fisheries; and discuss the potential promise (pros) and perils (costs) of fish trade. Policy recommendations for using fish trade to support the SDGs are provided under different headings that capture the main concerns highlighted in the literature when it comes to ensuring the sustainability of fisheries in general and those related to the impact of trade on fisheries sustainability in particular. The policy measures presented in this chapter have the potential to help ensure that trade in fish and fish products would support the implementation of the SDGs.

Reconciling fisheries catch and ocean productivity.

Photosynthesis fuels marine food webs, yet differences in fish catch across globally distributed marine ecosystems far exceed differences in net primary production (NPP). We consider the hypothesis that ecosystem-level variations in pelagic and benthic energy flows from phytoplankton to fish, trophic transfer efficiencies, and fishing effort can quantitatively reconcile this contrast in an energetically consistent manner. To test this hypothesis, we enlist global fish catch data that include previously neglected contributions from small-scale fisheries, a synthesis of global fishing effort, and plankton food web energy flux estimates from a prototype high-resolution global earth system model (ESM). After removing a small number of lightly fished ecosystems, stark interregional differences in fish catch per unit area can be explained (r = 0.79) with an energy-based model that (i) considers dynamic interregional differences in benthic and pelagic energy pathways connecting phytoplankton and fish, (ii) depresses trophic transfer efficiencies in the tropics and, less critically, (iii) associates elevated trophic transfer efficiencies with benthic-predominant systems. Model catch estimates are generally within a factor of 2 of values spanning two orders of magnitude. Climate change projections show that the same macroecological patterns explaining dramatic regional catch differences in the contemporary ocean amplify catch trends, producing changes that may exceed 50% in some regions by the end of the 21st century under high-emissions scenarios. Models failing to resolve these trophodynamic patterns may significantly underestimate regional fisheries catch trends and hinder adaptation to climate change.
